Will of Joseph Underwood Dec'd 1822

 

In the name of God Amen:

I, Joseph Underwoof of the State of Georgia and County of Elbert being Verry Sick in body but of

perfect mind and memory calling to mind the mortality of my body and knowing that it is appointed for all

men and once to die, do make this my Last Will and Testament.

First I give and recommend my soul to God who gave it and my body I recommend to the Earth to be Buried in decent Christian Burial, and as touching such Worldly goods wherewith it has pleased God to bless me in this world, I Give and Dispose of in the following manner and form.

First I give to My Well beloved wife Winifred one negro man named Lewis during her natural life or

widowhood and at her death or marriage to be sold and the money to be equally divided amongst my three sons William H. Underwood, Reuben Underwood and Joseph Underwood.

Also I give to my Eldest Son William H. Underwood the land on which he now lives all that part lying on the West Side of the Branch and All the Balance of the tract of land on which I live I give to my sons Reuben and Joseph to be equally divided between them at the death or marriage of my wife and to belong to my wife until her death or marriage.

I give to my daughter Elizabeth Norwood one nebgro girl named Citrithea after the death of my wife and to

remain the property of my wife untile her death.

I give to my daughter Sally Johnston one dollar and to my daughter Anne Patterson the sum of one dollar

and my daughter Polly Haley the sum of one dollar having given them heretofore all that I was able to do

I give to my son Reuben Underwood one negro boy named John and to my son Joseph one negro boy named Caleb after the death of my wife.

And my desire is that my land in Irwin County be sold and divided amongst all my children equally except

Anne Patterson having given her all that I intended in my lifetime heretofore all the balance of my estate I

give to my wife during her natural life or widowhood and afterward to my sons Reuben and Joseph.

Witness my hand and Seal this 25th day of November 1821, and I also appoint Reuben Underwood and William H. Underwood my Executors.

Personally appeared before us William Powell and being duly sworn saith that he saw Joseph Underwood

sign and publish the within instrument as his last will and testament and that he was then of sound and

disposing mind and that he saw Charles Wheeler and Permelia Norwood sign the same. Witnesses in his

presence and that She also signed the same as a witness in his presence. Sworn to and subscribed this

30th day of October 1822.

Personally appeared in open court Charles Wheeler and Permelia Norwood two of the subscribing witnesses to the above written instrument and being duly sworn saith that they saw Joseph Underwood Sen'r sign and

Publish the above written instrument as his Last Will and Testament and that they signed the same as

witnesses in his presence and at hi request and that he was then of sound and disposing mind and that they

also saw William R. Powell subscribe the same as a witness in his presence.
